Brest: Court Confesses Illegality of Detention of A.Sharenda and S.Navaselchan by Police
According to the information of a human rights activist Uladzimir Vialichkin, on 1 Brest Leninski borough court considered a complaint against illegal actions of the police filed by the democratic activists Stsiapan Navaselchan and Andrei Sharenda.
We should remind that on 16 July 2006 policemen from Brest Leninski borough police department detained Stsiapan Navaselchan, Palina Panasiuk and Andrei Sharenda, threatening them with criminal punishment in the case of refusal to come to a police station. They didn’t tell the reasons for the detention and composed no reports. The police only ‘talked’ with the detainees, took explanations and then let them go.
Having considered the case the court found that these actions of the policemen were illegal and violated the detainees’ freedom of movement. Therefore the court obliged Brest Leninski borough police department to compensate to the plaintiff A.Sharenda the court fee (about 14 US dollars) and compensate the court expenses (about 2 US dollars).
The court also made a private admonition addressed to Brest regional police department and Brest Leninski borough police department for violation of the law On applications of citizens and paragraph 1.6 of presidential decree #2 of 27 December 2006.
