Mahiliou: court turns down striker’s complaint
On 12 May Kastrychnitski district court of Mahiliou turned down the complaint of the activist of the Free Trade Union Belarus (FTUB), employee of Lausanbud enterprise Mikalai Rasiuk.
The reason for the complaint was that the activist was transferred from Mahiliou, where he used to work, to an object in the village of Duzhauka in Chavusy district.
The activist and his representative at the trial, FTUB lawyer Siarhei Famin consider this verdict groundless and are going to appeal against it.
‘The judge Tatsiana Karapetsian explained her decision with the specific of the building sphere. According to her, building objects can be placed in different parts of Mahiliou oblast and the administration can decide on relocation of the workers depending on the need in their work. In this case any manifestations of lawlessness can be referred to specific. The legislation tells nothing about any specif. There are no references to it in the labor contract, either,’ commented Siarhei Famin.
In his lawsuit Mikalai Rasiuk asked the court to abolish the order for his transfer and also to make the enterprise administration include the time he had to spend to get to work in the general labor time and compensate the excess time with days-off.
Mikalai Rasiuk believes that his transfer is connected with the strike of workers of construction administration #129 of Lausanbud. On 28 November 2008 he initiated an hour-long strike because of the wage arrears. Two days after the strike he was familiarized with the order for his transfer to another object.
