Ivan Kruk applies to General Procuracy

Ivan Kruk, a former deputy of the Astravets District Council of Deputies, addressed the General Procuracy of Belarus with an open letter, asking the Prosecutor General to ‘give a legal assessment to unlawful actions of the Astravets district territorial commission for elections to the local Councils of Deputies of the 26th convocation and bring the guilty persons to criminal responsibility.’

’I and three more people, Ulasevich N.M., Shushko L.B. and Hrazhul V.F. weren’t registered as candidates for the district council of deputies as a result of unlawful actions of members of the Astravets District Election Commission,’ writes Mr. Kruk. In particular, unlawful actions with the aim to prevent my registration as a candidate at the Shkolny election constituency #2 were undertaken by Chairperson of the Astravets District Election Commission and executive officer of the Astravets District Executive Committee Zimnitski together with a member of the committee, Svil V.M.. both of whom falsified the electoral documents.’

Ivan Kruk informs the Prosecutor General about receiving come-offs from the Astravets district and the Hrodna region procuracies. ‘Of course, I cannot agree with such a situation. The Astravets district and the Hrodna region procuracies issued knowingly unlawful rulings with rude violations of the existing legislation of the Republic of Belarus, which bears all traits of the penal act under Article 23 of the Criminal Code of the Republic of Belarus, ‘Crime against the constitutional rights and liberties of a person and a citizen’.’

Ivan Kruk asks the Prosecutor General to:

- give a legal assessment to the actions of the members of the Astravets District Election Commission Zimnitski M.V. and Svila V.M. and the prosecutorial officers who evaded from considering his applications and complaints on their merits;

- consider as groundless and unlawful the conclusion that was issued by the Astravets District Procuracy on 15 April 2010 concerning his application of 14 April 2010;

- charge the Hrodna region prosecutor with holding a complete and exhaustive check-up and restoration of the justice with bringing the guilty individuals to responsibility in conformity with the existing legislation of the Republic of Belarus;

- charge the Hrodna region prosecutor with taking measures on instigation of a criminal case against the duty officials Zimnitski M.V. and Svila V.M under Articles 23 and 25 of the Criminal Code of the Republic of Belarus on the basis of the results of the prosecutorial check-up concerning the violations of the electoral legislation, constitutional norms and criminal laws.
