Golden Lion denied registration again
The Hrodna Region Court didn't grant the appeal of the
organization founders against the registration denial by the Hrodna Region
Justice Department. The court explained it by referring to the absence of the
description of the procedure of appealing against decisions of the governing
structures of the NGO in its charter.
Meanwhile, this norm was present in the first charter, which was among the
registration documents passed to the justice department a year ago. When the
registration denial was appealed at the Supreme Court, the latter had no
pretensions to the document either.
The human rights defender Yury Chavusau who attended the trial, stated that
there appeared a legal collision, as the things that used to be lawful 1.5
years ago are now declared unlawful despite the absence of any amendments in
the related legislative acts.
That's why the appeal of the resent non-registration at the Supreme Court
promises to be quite interesting. “We can just put two almost identical
charters, and two different court rulings, in which the same legal norms are
explained in two different ways, side by side. It is an evident violation of
the uniform use of legislation,” commented Mr. Chavusau.
