Viasna suggests appealing dismissals of petitions for Bialiatski’s release

Numerous petitions for the pre-trial release of Viasna leader Ales Bialiatski have been dismissed by the State Control Committee investigators.

Lawyers of the Human Rights Center “Viasna” believe the dismissals are to be appealed, as the investigator violated a number of legal procedures, while issuing replies to the petitions.

Firstly, the replies fail to provide explanations on refusing to release Ales Bialiatski before the trial. Meanwhile, Article 137 of the Code for Criminal Procedures requires issuing a motivated decision on petitions.

Secondly, the dismissals should have been referred to the petitioners in person, and thirdly, the majority of the replies do not mention the procedures for appealing the dismissals.
