Bykhau: Investigative Committee sees no reasons to replace investigator in Shachanok's case
In the answer of the Bykhau district department of
the Investigative Committee of the Republic of Belarus, signed by its head
Savostsikau, it is stated that challenge of the investigator, demanded by
Shachanok, is impossible, as far as it can be done only within the framework of
Article 82 of the Criminal-Executive Code. Moreover, there are allegedly no
reasons to pass the case materials for review by another investigator.
Bear in mind, that before this the resident of the village of Dabuzha
(the Bykhau district of the Mahiliou region) was thrice refused in instigation
of a criminal case against the local police inspector who had fabricated an
administrative case against him).
The administrative case, brought against Mr. Shachanok for an alleged beating
of a neighbor, fell apart at court. The graphological expertise twice confirmed
that the signature under the violation report hadn't been put by Aliaksandr
Shachanok, but didn't manage to establish who had done it.
The policeman received just an oral remark from his brass and was deprived of
the wage bonus for it.
Following the third refusal to instigate a criminal case against the policeman,
Aliaksandr Shachanok applied to the Mahiliou Region Procuracy, which abolished
the refusal and returned the case to the Bykhau district department of the
Investigative Committee, which, in its turn, forwarded this case to to
investigator Samusenka – who had refused to bring the criminal case. Having
found about it, Mr. Shachanok decided to challenge the investigator, but was
denied this opportunity by the Investigative Committee.
