Mahiliou Court confirms KGB’s supervision over BCD activist
Judge
Yurchanka of Mahiliou Leninski District Court dismissed yesterday a complaint
lodged by the activist of the organizing committee of the party "Belarusian
Christian Democracy" Aleh Aksionau against local KGB department.
The
Judge ruled that the KGB acted within the law when establishing a preventive
supervision over the BCD activist and its actions comply with its direct
functions within its jurisdiction.
Aleh
Aksionau disagrees with the Judge's decision and is going to appeal it at Mahiliou
Regional Court within the next 10 days.
Human
rights activist Barys Bukhel notes that the KGB in its work goes beyond its
jurisdiction. The court also
ignored the statement by Aksionau that Art. 193-1
of the Criminal Code is unconstitutional and contrary to the requirements of
the Criminal Code itself. That
is, the criminal responsibility under Art. 193-1
is provided for the fact of activity on behalf of an unregistered organization,
not for dangerous acts and socially dangerous consequences, as provided by
Art.3 Par. 5 of the Criminal Code, which is called "the principles of
criminal law and criminal liability”.
“This
is an unreasonable and unlawful judgment, we're going to appeal against the
order," says the human rights defender.
