Draft law to require compensation for unlawful conviction on administrative cases

It is suggested by the answer to a query of a resident of Mahiliou Aliaksandr Khamratau received from the House of Representatives deputy Uladzimir Vasilenka, Nasha Niva reports.

Aliaksandr Khamratau:

“A draft law has been developed to amend the Code of Administrative Offences, as well as the Procedural Executive Code. The amendments are of the following nature: persons who were illegally brought to administrative responsibility will receive compensation for moral and material damages. Most importantly, the term of bringing to administrative responsibility will become a preclusive one.”

Aliaksandr Khamratau has been involved in an active correspondence with government officials and people’s representatives. He insisted that those who were illegally brought to administrative responsibility should receive compensation of material and moral damages.

Aliaksandr Khamratau says complaining to various authorities was suggested by a case that happened to him last year. Then, the traffic police on several occasions charged him with an alleged offense and could do so for an indefinite number of times in the same case.

“On July 28, 2012 the traffic police accused me of committing an offense. I appealed it. Then the traffic police has two months to make a decision – I was again brought to justice, and under our law it can be done endlessly. In the end, I sent statements to a member of Parliament Vasilenka and President of the Republic of Belarus. And I finally received written responses, according to which there will be changes to the Code of Administrative Offences and the Procedural-Executive Code of Administrative Offences concerning my suggestions.”
