Aliaksandr Sakharuk regularly deprived of wage bonuses for membership in independent trade union

Crane operator of the 5th grade Aliaksandr, who works in the Office of mechanization No. 127 of Building Trust No. 8 in Brest, is strugglng for his accession to the collective agreement.

The matter is that the collective agreement applies only to members of the official trade union. Mr. Sakharuk is a member of the Trade Union of Radio Electronic Industry, that's why according to Art. 41 of the Labor Code he needed to write an application to the Directorate for accession to the agreement. Mr. Sakharuk did it, after which he was dvised to write another statement to the trade union organization, which he also did. However, he received refusals from the Directorate and the trade union.

Only two points were specified for him in the agreement as a veteran of the war in Afghanistan: a paid day off on February 15, the day of withdrawal from Afghanistan, and a monetary reward. The worker was officially deprived of all other bonus wages and additional payments. Though he did not violate the labor discipline, he always had to apply to various state instances in order to get these bonuses. Eventually, he decided to go to court.

Maskouski District Court of Brest considered this situation as a collective conflict which could be resolved without instigation of civil proceedings. Sakharuk's appeal to a higher court yielded no results. On March 31 the labor contract of Aliaksandr Sakharuk expires. He was hinted that the contract would not be extended. The worker says it is quite bad if his company does not need skilled workers, but only loyal ones.

The legal inspector of the Trade Union of Radio Electronic Industry Uladzimir Malei, who helps Mr. Sakharuk in defending his interests, considers this situation as discrimination on trade union affiliation. Aliaksandr Sakharuk is going to appeal to international institutions after depleting domestic remedies.
