The Ministry of Justice has acknowledged that Regulations on records management in government agencies and other organizations establishes general requirements for documenting management activities in all public bodies and other organizations. This follows from the written reply received by Mahiliou journalist Ales Burakou.

As it is also stated in the response the organization and record keeping in the organizations established on the basis independently developed guidelines on records management must comply to the requirements of the Regulations.

In accordance with the
se regulations, the General Prosecutor's Office of the Republic of Belarus developed and approved in the prescribed manner the Regulations on records management at the Prosecutor's Office of the Republic of Belarus, whose provisions regarding registration and signing the documents are fully compliant with the Regulations.

The Ministry of Justice also acknowledged that
the signatures in the warrants for examination of a “site of administrative offense” of September 11 and 15 were put in the document with violations of requirements of paragraph 58 of the general regulations, as well as that of the regulations developed by the prosecutor's office: the signatures of the persons who authorized the examination of the premises of Aliaksandr Burakou didn't correspond to their official positions and the necessary information about the signatories was absent in the document.

In this regard, the Ministry of Justice recommended that the structural unit for Archives and Records Management
of the main justice board of Mahiliou Regional Executive Committee to hold a seminar on records management at the Leninski District Police Department and Mahiliou CIty Prosecutor's Office.

Meanwhile, it is impossible to bring to justice the person who violated the legislation on records management, as in 2009 Article 22.12, which envisaged penalties for violations in the records management, was eliminated from the Code of Administrative Offenses.


Due to the fact that
Mahiliou prosecutor Vulvach mislead journalist Burakou by writing in his answer that the regulations on record management in state bodies didn't concern the prosecutor's office, Ales Burakou is preparing a complaint with the Office of Prosecutor General.
