Journalist asks Office of Prosecutor General to teach records management to Mahiliou prosecutors

Ales Burakou has filed a complaint against the actions of the Mahiliou prosecutors with the Office of the Prosecutor General.

The Journalist requests that the Prosecutor General's Office acknowledged that instruction on records management at the state bodies and other organizations, approved by the Ministry of Justice of the Republic of Belarus on January 19, 2014 №4, sets binding general requirements for documentation management activities in government agencies, including prosecutors, police, KGB and all other law enforcement and government bodies.

Mr. Burakou also requests that the letter of the Prosecutor of Mahiliou Vulvach, as well as the warrants for the inspection of the “site of an administrative offense” (the apartment journalist and his parents) issued by Major Puhachou from the LeninskiDistrict Police Department of Mahiliou on September 11 and 15, 2014, were found non-compliant with p.2 , Part 1 ofp.18, Part 1 of p.46 and parts2 and 12 of p. 57 of the Instruction on records managementissued by the Ministry of Justice, and did not comply with the relevant paragraphs of the Instruction on records management at the Prosecutor's Office, developed by the Prosecutor General's Office to fulfill the requirements of p. 4 of the Instruction on records management of the Ministry of Justice.

In addition, the journalist asks to recognize the
warrants of the prosecutors for the inspection of the site administrative offense void. He seeks disciplinary punishment for the deputy prosecutors of Mahiliou Chupyrkin and Furmanau, the officer of the Leninski DPD of Mahiliou Major Puhachou, the prosecutor of Mahiliou Vilvach who, he believes, violated the legislation on records management, as well as the head of the division of the Mahiliou Regional Prosecutor's Office for for Supervision of over the law implementation and legality of normative documents, senior Advisor of Justice Stseniankova for his illegal refusal to consider the journalists appeal dated November 13, 2014.

Ales Burakou also draws attention to the fact that all the evidence that had been obtained from the study of the
computer appliances, seized from him and his parents, were obtained in violation of the law and therefore were legally void.

The journalist also seeks
the return of the Article 22.2 “Violation of the legislation on record management” to the Code of Administrative Offenses.

Let us remind that
October 8, Aliaksandr Burakou received a fine of 6 million rubles for allegedly violating part 2 of Article. 22.9 of the Administrative Code. The judge found the journalist guilty of working for the German radio station “Deutsche Welle” without an appropriate accreditation. The police are still keeping two laptops, seized from the journalist, referring to an expert examination.
