Judges don't fall under the jurisdiction of the courts
Judge of the Leninski District Court of Minsk Veranika Abramovich refused to instigate a criminal case on request of political prisoner Yury Rubtsou for recovery of moral damages of a judge of the same court, Kiryl Palulekh.
She stated that the case was beyond the jurisdiction of the court. On March 6 Mr. Rubtsou challenged the refusal at the panel of judges on civil cases of the Minsk City Court.
Yury Rubtsou, who is now serving of personal restraint in the village of Kuplin in the Pruzhany district tried to recover 18 average monthly wages from Judge Kiryl Palulekh to recover the moral damages.
"The judge judge me on behalf of the Republic of Belarus at the time, when I was naked from the waist up, thus showing a disrespect for me as a person. Actions of the judge on duty humiliated my dignity, made to fell humiliation and shame in front of the state symbols, namely the emblem and flag, as well as helplessness and vulnerability to arbitrariness and permissiveness of the official dressed in judicial robes. I was put in conditions of despair and hopelessness, because I had to stand before the court, in front of the state symbols naked to the waist,” argues Yury Rubtsou.
If the panel of judges denies him justice, Mr. Rubtsou is going to deplete all domestic remedies and then appeal to the UN Human Rights Committee.
